A Broken Arrow man is free after a judge rules that a picture he took, under the skirt of a teenage girl in a department store, did not violate any law.
This is the second time a judge has ruled the man, Riccardo Ferrante, did not break the law saying that the girl did not have any expectation of privacy because she was in a department store.
Assistant Police Chief Mike Carter may have to turn to city laws to keep the suspect from walking away free. He says the latest court ruling in the Ferrante case surprised him. It surprised others we spoke to as well.
"I am appalled that that person is not in prison, said Jane Snedden. "Clothes are private property. I can't believe he'd be allowed to get away with that."
State leaders have already started making changes to the law. According to one representative, the law would be amended to make the area under someone's clothing a private area.
