A judge's error caused a man who threatened an area school district to be released from jail.
The mistake happened Thursday in Tulsa, but the case involves the Skiatook school district. Less than 24 hours after his release, David Silvey, Jr. is now back behind bars.
We spoke with the judge, who told us he did make a mistake, but would not elaborate more. Additional security was added at Skiatook schools today because that mistake put people there on edge.
Silvey was charged with threatening an act of violence in October after he allegedly made threatening comments about the school system.
He had been in court Thursday when he was ordered released by the judge. Friday morning, Silvey was pick up at Tulsa's Day Center for the Homeless. Ironically, Silvey was taken into custody by Matt Hart, the the same officer who had arrested him last October.
"I said well David I think they made a mistake at the courthouse," Hart says. "There's been a minor mistake. And, he acted like he kind of knew there had been a mistake and he wasn't sure he was supposed to be released. Actually, he was coming from the jail. He had just been over at records checking to see if he had a warrant. I don't think he was convinced he was supposed to be out."
Silvey was not armed when he was taken into custody. His arrest was a joint effort by the Northern Oklahoma Violent Crimes task force. Silvey is due back in court next month.
