Oklahoma's multicounty grand jury has
accused a waste tire hauler of fraud and racketeering.
An indictment unsealed in Oklahoma County District Court Monday
charged Alan Keith Smiley of Marlow with defrauding a state program
created to recycle used tires. The 47-year-old Smiley faces 18
counts of fraud against the state and one count of racketeering.
Assistant Attorney General Joel-Lyn McCormick says Smiley is
accused of submitting fraudulent claims to the Waste Tire Indemnity
Fund that falsified the source, weight and number of tires he
transported.

The forms were then submitted to the Oklahoma Tax Commission,
which paid Smiley for his work.
McCormick says the state was defrauded out of at least $57,000.
If convicted, Smiley faces up to two years in prison on each
fraud count and at least 10 years for racketeering.
