Tulsa - A Tulsa man has pleaded guilty to accessory after the fact and has been given a suspended sentence in the death of a ten-month-old child two years ago.
Robert Boeckman was initially charged with first-degree murder in the killing of 10-month-old Eric McIntosh, who died January 4, 2007 from blunt force trauma to the abdomen.
But, the charge was amended to accessory after the fact. Thursday, Boeckman was sentenced to 14 months in prison, all of which was suspended. He was also given credit for time served.
A second count of assault and battery on a police officer against Boeckman was dropped.
Earlier this week, the child's mother, Sara McIntosh, was sentenced to six years in prison for child neglect in her son's death.
That means no one will be convicted of murder in the boy's death. A man identified as the boy's father, Glenn Starr, has filed a lawsuit against the Oklahoma Department of Human Services for negligence.
Glenn accuses DHS of failing to use reasonable care in placing the boy with McIntosh and Boeckman.
Officials say the boy was born with several illegal drugs in his system and that state and tribal courts kept him from his mother for several months before returning him to her.
