A group of concerned citizens has filed a lawsuit to stop the demolition of the B.C. Franklin Recreation Center.
The park is located along Virgin near Utica in North Tulsa.
The City Parks Department says the building is not safe and needs to be demolished.
But, neighbors say tax dollars were set aside to repair the park but were never spent on it.
A hearing on the issue was postponed Friday.
Neighbors against the demolition made their case at a Board of Adjustments meeting earlier this week.
$800,000 is available to rehabilitate the park.
A proposal included improvements like a multi-use sports court, a water playground and a large pavilion.
They did not include renovating the recreation center and pool.
The Parks Department insists, it is beyond repair.
But neighbors say, a third-penny sales tax in 2002 should have paid for improvements.
James Johnson, Sr. said Tuesday, "I want to know who the director in 2002 that mishandled, if you will, stole the money, that should have been put in that park. And the money was used in other areas."
Because of protests, the BOA voted down the proposal and asked the parks department to give the public more input.
