A federal judge in Oklahoma will decide if the Tulsa Police Department violated a captain's religious rights.
In 2011, Captain Paul Fields disobeyed an order to send officers to a "Police Appreciation Day" held at a Tulsa mosque.
Fields said it was against his religion and worried they might try to convert him.
He was then suspended two weeks without pay.
The American Freedom Law Center out of Michigan has filed a federal motion on Fields' behalf.
It claims police superiors, including Chief Chuck Jordan, retaliated against him and violated his religious freedom.
Attorneys want damages for loss of command, promotion and for being transferred to a graveyard shift.
