Charges Reduced Against Union Student In Bathroom Photo Case

Charges are reduced against a Union High School student accused of photographing another student in the restroom.

Jonathan D. Devito, 18, was arrested last week after the incident. School administrators and police said Devito admitted to taking a cell phone photo of a student's buttocks in the mens' restroom. He then allegedly Tweeted the photo out using his cell phone. Students alerted their teacher when they saw the picture on Twitter.

The Tulsa Count District Attorney's office has filed two misdemeanor charges for the incident. Devito was first held on felony complaints that can carry hefty fines and at least a year in jail.

First assistant district attorney Doug Drummond is handling the case.  

"Our review resulted in these two misdemeanor charges," Drummond said. "There was no question that poor judgment took place, but we do not believe the evidence supports the filing of any felony charges."

Drummond said the first charge alleges that Devito photographed another student's buttocks. The second charge alleges that Devito used his phone and Twitter account to send the photograph to others.

"Being sensitive toward others is an important life lesson for everyone, young and old," Drummond said. "Hopefully, the publicity from this case will serve as a strong reminder to respect a person's privacy."

Devito is currently out of the Tulsa County Jail on bond.
