Appeal Filed on Oklahoma Gay Marriage Ban Decision

An appeal has been filed by the Tulsa court clerk's office after a ruling stated that Oklahoma's ban on gay marriage is unconstitutional.

Earlier this week U.S. District Judge Terence Kern struck down Oklahoma's gay marriage ban after a lawsuit was filed by two same-sex couples. Additionally, Kern made the decision to stop the effects of his ruling anticipating an appeal.

"Judge Kern has come to the conclusion that so many have before him – that the fundamental equality of lesbian and gay couples is guaranteed by the United States Constitution," a statement described this week.

Oklahoma voters approved the ban back in 2004. Both couples listed above filed their lawsuits the day after the decision was approved.

The Denver court is also hearing an appeal in a similar case from Utah.
