Court Clerk Requests Expedition of Gay Marriage Appeal

Tulsa County Court Clerk Sally Howe Smith has requested a Denver court to expedite an appeals process after a ruling stated that Oklahoma's ban on gay marriage is unconstitutional.

KTUL learned that the appeal was filed last week by the court clerk's office for the 10th Circuit Court of Appeals in Denver. This was after U.S. District Judge Terence Kern struck down Oklahoma's gay marriage ban.

Smith told KTUL that she requested the appeals process to be expedited in hopes that the Oklahoma case could catch up to the Utah case that's also being heard in the Denver court.

"This case has been lingering for some time," Smith said. "We'll be bound by what they do with Utah unless its expedited and they hear both at the same time." 

Oklahoma voters approved the ban back in 2004 defining marriage as a union between a man and a woman. Two same-sex couples filed lawsuits the day after the decision was approved.

Smith said that the process could take some time before any final decision is made. Adding that a discussion over state's rights could come into play.

"It could go all the way to the Supreme Court," Smith said "That would not surprise me."
